A lease agreement grants a tenant the right to occupy a property for a fixed term — commonly six or twelve months for a home, several years for a commercial unit — in exchange for rent, on terms that are locked for the duration. That fixed term is what distinguishes a lease from a month-to-month rental agreement, and it’s what makes the questions of early exit, renewal, and rent review matter. The free templates below are editable MS Word files for residential and commercial leases, and beneath them you’ll find the clauses specific to fixed terms and what happens when either side wants out early.

Note: These templates are general formats, not legal advice. Residential tenancies are heavily regulated, and many jurisdictions impose mandatory terms that override whatever a lease says — on deposits, notice, rent increases, repairs, and grounds for ending a tenancy. Commercial leases are less regulated but carry far larger sums and longer commitments. Check the rules where the property is located, and for any commercial lease or residential lease of significant value, have the agreement reviewed before signing.

Lease, Rental Agreement, or Commercial Lease?

Three arrangements that are often lumped together, and choosing the wrong one is the most consequential decision on this page:

If you want flexibility, our rental agreement templates cover month-to-month tenancies — including deposits, required disclosures, and move-in condition reports, all of which apply equally to fixed-term leases. This page covers what’s different when the term is fixed.

What a Lease Must Contain

Parties — the landlord (lessor) and every adult tenant (lessee), with full legal names and a service address for notices.

Property — the full address and exactly what’s included: parking, storage, garden, furniture, appliances.

Term — a specific start date and end date. “Twelve months” isn’t enough; “1 October 2026 to 30 September 2027” is.

Rent — amount, due date, method, and late payment terms.

Rent review, if the term is long enough to need one — when, how, and on what basis.

Deposit — amount, where it’s held, and the conditions for return.

Break clause, if there is one — see below.

Repairs and maintenance — who is responsible for what.

Use and occupancy — who may live there, pets, smoking, alterations.

Assignment and subletting — whether the tenant may transfer the lease or let part of it, and whether landlord consent is needed.

Landlord access — notice required for entry.

What happens at the end of the term — expiry, renewal, or continuation on a periodic basis.

Signatures and date, with witnessing or registration where your jurisdiction requires it for the length of term.

Ending a Lease Early

This is the issue that defines a fixed-term lease, and it causes more disputes than anything else in it.

The default position in most jurisdictions is that a tenant who leaves before the end date remains liable for the rent until the term expires. Signing a twelve-month lease is committing to twelve months’ rent.

But there’s an important qualification many landlords and tenants don’t know about. In a large number of jurisdictions, a landlord whose tenant leaves early has a duty to mitigate — to make reasonable efforts to re-let the property rather than leaving it empty and billing the departed tenant for every remaining month. Once a new tenant moves in, the original tenant’s liability usually ends. The specifics vary, and in some places the duty doesn’t apply, but it’s worth knowing on either side of the arrangement.

There are three cleaner ways to handle early exit, and a well-drafted lease uses at least one:

A break clause. A right for either party — or just the tenant — to end the lease early at a set point, with notice. The common residential form is a break after six months of a twelve-month term, on two months’ notice. It gives the tenant an exit and the landlord certainty for the first half. Negotiate it in before signing; adding one afterwards requires the landlord’s agreement.

An early termination fee. A stated amount — often one or two months’ rent — that releases the tenant from the remaining term. Check your jurisdiction permits it, and that the amount is a reasonable estimate of the landlord’s loss rather than a penalty.

Assignment or a replacement tenant. The tenant finds someone acceptable to take over the lease, with the landlord’s consent. Many leases allow this, and it’s usually the arrangement that costs everyone least.

Whichever route applies, put the agreement to end early in writing. A verbal “that’s fine, go” from a landlord is the start of a dispute about the deposit three months later.

When the Term Ends

Three things can happen at the end date, and the lease should say which:

It expires. The tenant leaves, the property is inspected against the move-in condition report, and the deposit is returned less any agreed deductions.

It’s renewed as a new fixed-term lease, often with a rent review. Agree renewal in writing well before the end date — two months ahead is sensible — so neither side is left guessing.

It continues on a periodic basis. In many jurisdictions, if the tenant stays after the term and the landlord keeps accepting rent, the tenancy automatically becomes month to month on the same terms. That’s why so many tenancies end up as rental agreements whether or not anyone intended it — and why it’s worth deciding deliberately.

Either way, the end-of-tenancy inspection works exactly as described on our rental agreement page: compare against the signed condition report, distinguish damage from fair wear and tear, and itemize any deductions. Keep rent receipts for the whole term — they settle any argument about what was paid.

Commercial Leases

A commercial lease covers the same ground as a residential one and adds several clauses that don’t arise when someone is renting a home. They’re also where the money is — a five-year commercial lease is often one of the largest commitments a small business makes.

Permitted use — what the premises may be used for. Drawn too narrowly, it can stop you changing what you sell; check it against your business plan, not just your current trade.

Rent review — typically every few years, on a stated basis: open market rent, an index, or fixed increases. Upward-only review clauses are common in some markets and worth understanding before signing.

Repairing obligations — who maintains what. Under a full repairing lease the tenant is responsible for the structure as well as the interior, which on an older building can be very expensive.

Service charges — the tenant’s share of maintaining common areas in a multi-let building. Ask for the last few years’ figures.

Alterations and fit-out — what you may change, whether consent is needed, and whether you must reinstate at the end.

Dilapidations — the tenant’s liability for the property’s condition when the lease ends. This can produce a large bill at exactly the moment a business is moving out, so a schedule of condition at the start is essential.

Break clauses — often with strict conditions attached, such as rent paid up to date and vacant possession given. Miss a condition and the break can fail.

Security of tenure — in some jurisdictions business tenants have statutory rights to renew; in others, those rights can be excluded. Know which applies.

For a commercial lease of any significance, a template is a starting point for negotiation, not a document to sign as it stands. Take advice before committing.

Frequently Asked Questions

What is a lease agreement?

A contract granting a tenant the right to occupy property for a fixed term in exchange for rent, with the terms — including the rent — generally locked for the duration. It’s used for both homes and business premises.

What is the difference between a lease and a rental agreement?

A lease runs for a fixed term, typically six or twelve months for a home, and its terms are locked for that period. A rental agreement is periodic — usually month to month — renewing automatically until either side gives notice, with terms that can change on proper notice.

Can I end a lease early?

Only through a break clause, an early termination arrangement, a replacement tenant, or the landlord’s agreement. Otherwise the tenant usually remains liable for rent until the end date — though in many jurisdictions the landlord must make reasonable efforts to re-let the property, which limits that liability in practice.

What is a break clause?

A term allowing one or both parties to end the lease early at a specified point, with notice. A common residential example allows either side to end a twelve-month lease after six months on two months’ notice. Commercial break clauses often carry strict conditions that must be met exactly.

What happens when a lease ends?

The tenant either leaves, signs a renewal, or — in many jurisdictions — stays on and the tenancy automatically becomes periodic on the same terms. Decide deliberately and agree it in writing before the end date.

What is the difference between a residential and a commercial lease?

Residential leases are heavily regulated, with many terms fixed by law. Commercial leases are largely negotiated, usually run much longer, and add clauses on permitted use, rent reviews, repairing obligations, service charges, and dilapidations.

Does a lease need to be registered or witnessed?

It depends on the jurisdiction and the length of the term. Many places require leases above a certain length to be in writing, witnessed, or registered, and some require specific formalities for commercial leases. Check the requirements where the property is located.

A rental agreement sets out the terms on which a tenant occupies a property: how much rent, when it’s due, what the deposit covers, who fixes what, and how either side ends the arrangement. Most rental agreements run month to month — they renew automatically and end on notice — which makes them the flexible alternative to a fixed-term lease. The free templates below are editable MS Word files, and beneath them you’ll find every key clause explained, plus the deposit and disclosure rules that cause most landlord-tenant disputes.

Note: These templates are general formats, not legal advice. Residential tenancies are among the most heavily regulated agreements there are — many jurisdictions impose mandatory terms that override whatever a contract says, prescribe specific forms or disclosures, and cap or control security deposits. Before using any template, check the rules for the state, province, or country where the property is, and have the agreement reviewed if the tenancy is of any significant value.

Rental Agreement or Lease?

The terms get used interchangeably in conversation, but they describe two different arrangements — and choosing the wrong one is the most consequential decision on this page:

A rental agreement is usually periodic, most often month to month. It renews automatically at the end of each period and continues until either party gives notice — commonly 30 days. The landlord can generally change terms, including rent, by giving proper notice.

A lease is for a fixed term, typically six or twelve months. The terms, including rent, are locked for the duration, and neither side can end it early without cause or a penalty clause.

Which suits you depends on what you’re optimizing for. A rental agreement gives flexibility to both sides — useful for short-term tenants, uncertain circumstances, or a landlord who may want the property back. A lease gives certainty — guaranteed occupancy and fixed rent for the tenant, guaranteed income for the landlord. Landlords letting long-term usually prefer a lease; those testing a tenant or a market usually start month to month.

Note that in many jurisdictions, when a fixed-term lease expires and the tenant stays on, the tenancy automatically becomes periodic on the same terms — so a great many tenancies end up as rental agreements whether or not anyone intended it.

What Goes in a Rental Agreement

The parties — landlord’s full legal name and a service address, and every adult tenant named individually. Everyone named is usually jointly responsible for the whole rent.

The property — full address including unit number, and what’s included: parking space, storage, garden, appliances, furniture.

Term — the start date and the period (“month to month, commencing 1 October 2026”).

Rent — amount, due date, payment method, and where it’s paid. Add the late fee and the day it applies, if your jurisdiction permits one.

Security deposit — amount, what it may be used for, and how and when it’s returned. See below.

Utilities and services — which the tenant pays, which the landlord pays, and how any shared costs are split.

Maintenance and repairs — landlord responsibilities (usually structure, heating, plumbing, and anything statutory), tenant responsibilities (usually cleanliness, minor items, and damage they cause), plus how to report a repair and expected response times.

Use and occupancy — who may live there, guest limits, subletting, pets, smoking, home businesses, and alterations.

Landlord entry — the notice required before the landlord may enter, and the circumstances. Most jurisdictions set a minimum (24 or 48 hours is common) with exceptions for genuine emergencies. This clause exists to protect the tenant’s quiet enjoyment, and ignoring it is one of the fastest ways for a landlord to end up in trouble.

Termination and notice — how much notice each party gives, in what form, and what happens at the end: final inspection, keys, forwarding address.

Rent increases — the notice required, and any local cap or control that applies.

Signatures and date, plus any witnessing your jurisdiction requires. Give the tenant a signed copy.

Security Deposits

More landlord-tenant disputes come from deposits than from anything else, and most of them are avoidable with three lines in the agreement and one document at move-in.

State in the agreement: the exact amount taken, what it may be deducted for (unpaid rent, damage beyond fair wear and tear, cleaning to the standard at move-in), and the timeframe for returning it after the tenancy ends.

Then check what your jurisdiction requires, because deposits are regulated almost everywhere and the rules bite:

Maximum amount — many places cap deposits at a multiple of monthly rent.

Where the money must be held — some jurisdictions require a separate or escrow account; the UK requires deposits to be protected in an approved scheme within a set period, with penalties for failing to do so.

Deadline for return — commonly between 14 and 30 days after the tenancy ends.

Itemized deductions — most rules require a written breakdown of anything withheld, often with receipts.

Interest — some jurisdictions require deposits to earn interest for the tenant.

The recurring theme in deposit disputes is fair wear and tear. Carpets thin, paint marks, and fittings age — that’s the landlord’s cost, not the tenant’s. Damage is different from deterioration, and the way you prove which is which is the condition report below.

Required Disclosures

Many jurisdictions require landlords to give tenants specific information at or before the start of a tenancy, and failing to do it can affect your ability to end the tenancy or keep a deposit. What’s required varies, but commonly includes:

Lead paint — in the US, federally required for most housing built before 1978, with a specific pamphlet and disclosure form.

Deposit protection details — in the UK, the scheme used and prescribed information, within a set deadline.

Energy performance certificate — required in the UK and across much of the EU before letting.

Safety certificates — gas, electrical, and smoke or carbon monoxide alarm confirmations, depending on jurisdiction.

Landlord’s name and service address, so the tenant knows where to send formal notices.

Local specifics — flood zone, mold history, bed bug history, rent control status, and others apply in particular states and cities.

Attach the disclosures to the agreement and have the tenant sign for receipt. It takes a minute and it’s the evidence that they were given.

The Move-In Condition Report

The single most useful thing you can attach to a rental agreement is a condition report completed at move-in: a room-by-room record of the state of the property, with dated photographs, signed by both landlord and tenant.

Walk the property together before the tenant moves furniture in. Note the condition of floors, walls, fittings, appliances, and anything already damaged, and photograph everything — including the things that seem too minor to bother with, which are precisely the ones that get argued about later. Record meter readings and the number of keys handed over while you’re there.

At the end of the tenancy you repeat the exercise against the same document. With a signed, photographed baseline, deposit deductions are a five-minute comparison. Without one, they’re one person’s memory against another’s, and in most jurisdictions the burden of proving damage sits with the landlord.

Alongside the agreement, keep the paperwork that goes with a tenancy: rent receipts for every payment, particularly where rent is paid in cash, and a record of repair requests and responses.

Frequently Asked Questions

What is the difference between a rental agreement and a lease?

A rental agreement is usually periodic — month to month — renewing automatically and ending on notice, with terms the landlord can change on proper notice. A lease runs for a fixed term, typically six or twelve months, with terms locked for the duration. Rental agreements offer flexibility; leases offer certainty.

How much notice is needed to end a month-to-month rental agreement?

Commonly 30 days from either party, but notice periods are set by local law and can differ for landlords and tenants — some jurisdictions require 60 or 90 days from a landlord, or restrict the grounds on which a tenancy can be ended at all. Check your local rules rather than relying on the template’s default.

Can a landlord raise the rent during a rental agreement?

Under a periodic agreement, usually yes, with proper written notice — though many places set minimum notice periods, limit how often increases can occur, or cap the amount under rent control. Under a fixed-term lease, the rent is normally fixed until the term ends.

Is a verbal rental agreement valid?

In many jurisdictions a verbal tenancy is legally valid, and statutory protections still apply to it. That doesn’t make it a good idea — without a written agreement, disputes about rent, deposits, repairs, and notice come down to competing recollections. Some places also require certain tenancies to be in writing.

Does a rental agreement need to be notarized?

Usually not, though requirements vary and some jurisdictions require witnessing or registration for longer tenancies. What matters more is that every adult tenant signs, each party keeps a signed copy, and any required disclosures are attached.

What can a landlord deduct from a security deposit?

Typically unpaid rent, damage beyond fair wear and tear, and cleaning needed to restore the property to its move-in condition. Normal deterioration — worn carpet, faded paint, aging fittings — is the landlord’s cost. Most jurisdictions require an itemized written statement of deductions within a set period.

How much notice must a landlord give before entering?

Most jurisdictions set a minimum, commonly 24 or 48 hours, with exceptions for genuine emergencies. State the period in the agreement, and follow it — repeated entry without notice can amount to harassment and undermines the landlord’s position in any later dispute.
